Gameware has filed a trademark application for the mark “JAMES POND” for video games, clothing, toys, and entertainment services. The mark is clearly a parody of the famous spy 007. The owners of the James Bond trademarks are, of course, objecting to this.

Gameware argues that the game has been on the market since the 1990s and that the trademark has built up its own reputation. Does this stand a chance of success?

In my view, no. In this case, it is clearly a matter of riding on the coattails of another brand’s fame. I therefore expect the trademark to be rejected (and an argument based on parody will not hold up either—see the IKEA ruling).
