For companies, an online presence is essential. Consumers increasingly search for information online, and businesses must adapt to this trend. An important question to consider is: How will consumers find my website?
A search query can generate hundreds of thousands of results (known as a natural search). While consumers may browse the first few pages, they rarely go beyond that—making a first-page ranking crucial. But how can you achieve this? Can you legally use a competitor’s well-known brand in Google Ads (formerly AdWords) to improve your website’s visibility? Or, conversely, could a competitor use your brand to attract traffic to their site? The use of competitors’ trademarks in Google Ads is subject to strict regulations.
Another important factor is the use of trademarks in domain names. Can a distributor register a domain name containing a trademark? Can a competitor register a similar domain name (e.g., with a typo or by adding terms like “online store”) and redirect traffic to their own website? Domain monitoring helps track who is registering what, providing clarity on potential conflicts.
Additionally, online counterfeiting is a growing issue. The sale of counterfeit goods on Chinese platforms like Alibaba is increasing, often at unrealistically low prices. Some websites even offer made-to-order counterfeit products. As infringement shifts further into the digital world, most online marketplaces have implemented procedures to combat abuse. Trademark, design, and copyright protections often serve as effective tools to halt such violations.
